In an extraordinary display of forgiveness that has captivated the nation, the daughter of a woman killed in a horrific road collision involving a police car has pleaded for the officer responsible to be spared a prison sentence. Yet, in a move that has sparked intense debate over justice and duty, a judge has turned a deaf ear to the family’s mercy, sentending the “heartbroken” veteran to 27 months behind bars.

A Fatal Dash to Save a Life

The tragedy unfolded on a nondescript stretch of road in Gateshead, Tyne and Wear, in July 2022. PC Mark Roberts, 57, a former soldier with a “remarkable” record of public service in the world’s most dangerous war zones, was at the wheel of a marked police vehicle when the call came in.

It was a grade-one emergency: a five-week-old baby was choking.

The ambulance service had requested immediate police assistance, a signal that paramedics feared they could not reach the infant in time. For Roberts, every second was a heartbeat. Activating his blue lights and sirens, he raced from Whickham police station, desperate to reach the child.

But at a junction where the light had been red for six seconds, the mission of mercy turned into a nightmare.

Roberts, travelling at 43mph in a 30mph zone as he approached the lights, struck a motorcycle carrying 74-year-old Ronald Pinkney and his wife, Muriel. The impact was devastating.

‘A Tragic Accident’

Mrs. Pinkney suffered catastrophic head and neck injuries and was pronounced dead shortly after. Her husband, Ronald, was left fighting for his life with a bleed on the brain and multiple fractures.

Recalling the final moments before the crash, Roberts told Teesside Crown Court:

“The next thing I recall is there was a bang and both airbags deployed… I believe this was a tragic accident.”

The veteran officer, who had previously served in Yugoslavia, Afghanistan, and Iraq, was described as being “utterly heartbroken” by the consequences of his actions. He had spent his life protecting others, only to cause the very tragedy he spent his career trying to prevent.

What makes this case truly unique is the reaction of those left behind. In a world often defined by litigation and vengeance, the Pinkney family chose a different path: empathy.

Dawn Hunter-Pinkney, the couple’s daughter, stood before the court not to demand retribution, but to offer a shield for the man who killed her mother. In a victim impact statement that silenced the room, she insisted the family did not want the former officer to be jailed “for doing his job.”

“We were angry, but the more we hear about why the officer was driving the way he was, the more we understand,” she said. “We do accept this is a very tragic accident with a very tragic outcome, but sending the officer to prison won’t bring Mam back.”

The Weight of the Law

Despite the family’s remarkable plea, the legal system proved unyielding. Judge Francis Laird KC acknowledged Roberts’ exemplary character and the “remarkable life of public service” he had led, but he remained firm on the point of law.

The court heard that Roberts was still travelling at 25mph when the collision occurred, and his speed approaching the “stop” signal was deemed too high for the conditions.

“Only a custodial sentence can be justified for these offences,” the Judge declared. “Your speed as you approached the junction was too high.”

Roberts was found guilty of causing death by dangerous driving and causing serious injury by dangerous driving. He was led away to begin a 27-month sentence, leaving behind two families shattered—one by loss, and the other by the heavy price of a split-second decision made in the line of duty.

The sentencing has ignited a fierce debate. On one side, legal experts argue that the law must be applied equally, regardless of the defendant’s intentions. They contend that a red light is a hard limit, even for those responding to a 999 call.
